Death warrant has been issued for the all 4 accused of nirbhaya case and 22nd January 7 a.m. is the time at which the execution of the all four accused will  take 10 place. The actual incident happened on 16th December 2010 when five adult man and a juvenile had lured a 23 year old women and her friend letter women died due to injuries caused by them.

All the nation today celebrating the death sentence of these four offenders. Bihar human and where we are going how a human can celebrate death warrant of person.. everybody is praising the judiciary everybody racing Battle of of Justice fought by the mother of the nirbhaya. But really  the death of the 4 people will be a reason of celebration?

There are some fact are being presented in front of you everything upon whether there could be any other punishment what from the capital punishment.

1. The all 4 convicted persons comes from economically backward class. They don't have enough means live a good life.for their daily food they have to work daily otherwise they have to sleep with empty stomach. And all the legal process is quite expensive even they could not have a good advocate to represent their case before Court of the law.

2. All for converted person are not well educated, they only know the letters they only know Hindi language they only can read even they cannot understand Hindi language in the return form properly. It means they are not well educated. Education is the tool which brings change in the personality of any person. Education is the real jwel of any person which brings wisdom to him. How much we can expect from UP educated person. How much good behaviour we can expect from a person who is not vel educated. How much Civic sense we can expect from a person who never have been so high class of the Civic sense.

3. The atmosphere where the all 4 convicted person living were so poor. They had not any kind of the intellectual activities around them even nothing was done from the the side of the government to enrich those people with high values high thoughts and education. They all were leaving a third world grade life. So how much gentle behaviour we can expect from these people.

4 age of the all for accuse is near about 21 year old when the offence was done. It was more below which was near about 18 year old of most of the convicted person. This very short age psychologically is not very enough age to have a good mind so that it could understand every circumstances. A poor educated mind needs a chance to get a development.

Not out their act is very brutal they don't deserve any Mercy but also they deserve a sentence as per their economic social cultural intellectual conditions. A person who always have lived in the scarcity of all human needed fundamental things which is the responsibility of government to provide them under article 21 to live a a good life and they had nothing wanted by the government to live a good life. There are nearly 143 countries in the world who have abolished the death penalty either by the law or by the practice.

In jurisprudence there could be many reason and many form of the punishment which target different outcomes from the punishments but the major outcome of Samson is to bring reform in the personality in the the activity in the thought in the lifestyle of the accused and convicted person. Telling someone for any offence never had been a solution to stop the offence. If someone has killed anyone and we kill him was established procedure of the law it means itself doing some kind of the violence on the other hand law is is always progressive and creative and by the law killing someone is not progressive neither creative.

Since the office had been done from the all six accused one of which has been died in the jail during the trial and one accused who was juvenile at the time of commission of offence he was released as per the law. They must have given a chance to prove that whatever was done by them was a mistake was a blunder was a fault. They must have given an opportunity  to live a good life and do something very creative what is society and for the nation.
